Any additional charges incurred which directly relate to the completion of any photographic assignment will be recovered from the client.

No traveling expenses or accommodation will be incurred by the client unless the photographic assignment is a distance greater than fifty miles from the studio, however it may be necessary to travel on the evening prior to the photographic assignment to avoid traffic and other problems which may arise, also it may also be necessary from time to time to stay overnight where an assignment either runs late or is a long distance from the studio. The cost of any accommodation shall be incurred by the client with regards to late and distant weddings.

Food and beverages must be provided to all accompanying photographers where attendance is over five hours in duration.

Payment:

A quotation will be issued upon booking a photographic service or assignment & is subject to change, should the client modify any individual package or alter any additional & precise requirements.

The company cannot provisionally hold a date open without a reservation fee of twenty percent of the issued quotation, this is to be made payable to the company at the time of booking & allow the company to secure the reservation, event booking or photographic service or assignment.

The reservation fee is a non refundable fee.

A remaining balance of the quotation value is payable four weeks prior to the reserved photographic services or assignment date.

Non-payment of the required monies due including the reservation payment or full payment of the quotation value, constitutes a breach of contract from the client. Any previous contract which is in place at this time will become null and void.

Payments are non refundable except in what is felt by the company to be exceptional circumstances.

All prices and packages are subject to change. Prices are adjusted periodically where felt necessary although reserved & confirmed bookings are valued & priced at the time of booking.

Any returned unpaid payments shall incur a thirty pound administration & penalty charge.

Exclusivity:

The company shall be the only exclusive professional photographer retained by client for the agreed photographic service or assignment.

Family and friends are permitted to take photographs as long as they do not disturb or disrupt or interfere with official photographer’s duties.

The photographer has the right in necessary to kindly ask any person obstructing a shot to refrain from doing so, in order for the photographer to carry out their duties.

Any breach of this agreement will constitute a reason for non-completion of the photographic service or assignment with no liability to either the photographer or the company.

Publicity:

The company reserves the right to use any images taken for any form of advertising to promote the company. These promotions can include web based promotions, brochures, galleries competitions, however this list is not exhaustive.

Inherent Quality.

Clients should be aware that colour dyes in photography may fade or discolour over a period of time due to inherent quality of dyes and insufficient care and preservation of prints & albums.

The photographer or the company will not be held responsible for any damage of albums and prints that were dispatched or delivered undamaged.

The photographer or the company will not be liable for degradation of images due to poor handling and insufficient care. It is advised that all albums and images need to be kept at room temperature, stored in a box; away from heat and direct sunlight as these sources will reduce the life of your album and images.

If the photographer or the company are unable to fulfill the role of wedding photographer on the day due to any unforeseen circumstances, a full re-fund will be given to client but no further liability will be sought with respect to any agreement from the photographer or the company. This limitation shall also apply in the event that photographic materials are damaged, lost, stolen, camera malfunction or any other damage without fault of the company.

If any photographic service of assignment agreement is canceled by the client no refund shall be given due to loss of business incurred by the company.

The photographer or the company cannot be held responsible for images and photography sessions being disrupted by adverse or unfavourable weather conditions, war or what is generally described as an act of god..

The company may substitute photographers in the event of a photographer’s illness or accident.

All & any re-orders shall be an extension of this contract & any re-orders must be paid for in full prior to orders being dispatched.

The photographer or the company will not be held responsible for the lack of coverage caused by the actions, restrictions or timings of the client or their associates & family whilst undertaking the photographic service or assignment.

The photographer or the company will not be held responsible for the lack natural lighting within any location venues, on camera flash lighting will be provided where necessary although it is not always possable to light an entire room.

The photographer or the company will not be held responsible for the church, reception, hotel etc having restrictions that prevent images being taken.

The photographer or the company will not be held responsible any images which are interfered with by other camera flash lighting used by guests or venue staff.

The photographer or the company cannot guarantee any specific image nor incorporate any specific background or group arrangement.

The photographer or the company will not be held responsible for customer disappointment of agreed album and images as long as they are technically acceptable and will face no liability.

Any announcement made that will affect your photography and the day, timings, venues etc should be forwarded for notification as soon as possible.

Any circumstances not bought to our attention that affect the out come of the photography will not be the responsibility of the photographer or the company.

A map should be provided if necessary to prevent photographer getting lost, contact details of all venues should be provided. & the photographer or the company will not be held responsible for being misinformed.

Due to technical processing, the photographer or the company cannot guarantee exact colour matching.

The company cannot be responsible for print selection errors whether re-prints or album prints.

The photographer or the company cannot be responsible for the damage to CD-ROMs provided, appropriate care is the client’s responsibility.

All albums, photo proofs, discs etc will be either posted using recorded delivery or delivered in person, however the company accepts no responsibility for the reliability of the postal service. We cannot be held responsible for loss or damage of mail, prints, albums frames and disks etc that are sent through the post.

It is advisable that you make a copy of your booking form for your own benefit.

The photographer or the company may take no responsibility for the slight colour change from proofing to final completed images. Under no circumstances can we guarantee that the colour of the proofs supplied and the colour of the final images will be exactly the same.

All of the above agreements apply to all of our work and albums.

Terms and conditions may change at any time.

The copyright of all the photographs produced is passed to the client upon full payment, however the company retains the copyright over the RAW images as they do not represent the finished image & the company reserves the right to use any images produced from the RAW images for promotion.

A copy of all photographs taken on each assignment will be archived by the company, both physically & digitally.

No intimate photographs taken will ever be shown to other prospective clients, clients or third parties & will not be used by the company in the course of the day to day operations & promotion of the business.

Every care is taken during any photographic assignment, photographing and processing using professional materials, equipment & laboratories & in the unlikely event of total photographic failure i.e. during exposure or processing, or printing the Photographer's liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected, and the company has full Public Liability Insurance.

Cancellation.

Cancellation may take place at any stage providing at least eight weeks cancellation notice for non studio photography is provided prior to the reserved photographic date, where upon payments due will be required for any photographic work already completed up to the point of cancellation & or any payments received for any unused photographic work ( excluding any reservation fee ) will be returned in full. Should eight weeks notice of cancellation not be received a cancellation fee will be levied which will be a fee of ten percent of the quotation total.
